PEJ News - C. L. Cook - David Arthur Johnston, the "right to sleep" protester sentenced to seven months in Wilkinson Road Correctional Facility was granted bail today in Victoria.

Johnston had been on hunger strike since his July 5 incarceration for failing to honour an agreement made with the Crown to leave the province. He's been repeatedly arrested for sleeping on the grounds of the Saint Anne's Academy grounds, arguing it is his, and other's sleeping out-of-doors, right to make use of "public" property.

Johnston had always maintained a fast while in prison, though his scores of previous arrests have been shorter, and his friends, family, and supporters worried that his determination not to eat while in prison would prove fatal during this longer sentence.

After more than a month without food, Johnston lost more than thirty pounds.

David's mother, Leah Johnston, who travelled to Victoria from Alberta to be near her son, and reports tonight David's bail hearing today went well, and he is now staying with family friends outside Victoria. She thanks all the "angels" she's met in Victoria who offered she and David support, and says her son will be back in court in October.
